    In fact AmigaKit UK but that can lead further.
    Its known I am displeased with AEON, Hyperion and AmigaKit as x1000 customer,
    and I decided to act.

    And last swan dance that leads AEON and Hype to court, after one week resulted in 1 year censorship ban on AW.net thread

    Thanks but no thanks. As soon I read the words sue, court or lawsuit in Amiga context I quit reading and close the tab out of sheer boredom... I must admit - I missed this one out now, not accustomed to such topics popping up on morph.zone - but I'll continue to do so again from now on. ;-)

    Its my private process for small fee refund on OS 4.2 license and damages.
    Nothing between big companies, just small mans case of exercising end user customer rights
    in UK from Serbian resident. Very wicked, but none of other x1000 users had balls to do the same


    P.S.
    When I say any comments and advices are welcome, I dont mean "this does not interest me" comments :)

    You bought into a Hype for a product with questionable value and connected to questionable characters from the get go. There is very little money you could claim with noone capable AND legally mandated to pay you back.

    All agreed, but Serbs do like having balls for just cause.
    I finally I have some money to spare.
    I do desire just to have them sweat on legal notes from UK court system
    that cares from customers, even from shit holes from Serbia, if product is sold from UK vendor.

    First AmigaKit in court and if they try smoke and mirrors, whomeever judges find guilty.
    I just wish they try ignore and smoke and mirrors in real UK court and those popcorns
    I will invest.

    I ve hired Cardiff law yars, and yes indeed, it will cost 400 GBP to litigate,
    with me demanding 480 :D But if loosing side pays all the bills, its OK.

    We ll see do I get interest on that short waiting period for OS 4.2 :D

    Anyway, I ll proceed, its matter of responsibility, not earning.

    Instead they sold me about 200e hw and 200e software that was to partialy mitigate what full final OS 4.2 would do (OS 4.1 beta 5 did not support much of x1000 hardware)

    The offer of 4.2 was made by Hyperion Entertainment who were partners of the original A-EON Technology CVBA company. You should contact them and ask where OS 4.2 is ?

    A-EON Technology Ltd produced the later X5000, A1222+ and are nothing to do with Hyperion or the CVBA company. Due to the problems and delays with OS4 development, A-EON Technology Ltd was forced to create the Enhancer Software to be able to release the X5000/A1222+.

    AmigaKit Ltd has nothing to do with any of the above.

    Clear now? Topic needs some IT knowledge, imagine having Windows XP with no drivers for half hardware on PC, forcing you to buy un needed hw that is supported, new software and that Windows 7 that would support fully your hardware was never given to you. You would sue
    company that charged you, its on them to go down the lane and refund cost.

    with betaOS with promise of final version prepaid,

    But product was never delivered.



    Proof of purchase can be obtained from both parties,
    while AmigaKit

    Beside named fee (about 80GBP) damages caused by undelivery were purchases of additional software
    AmigaOS 4.1 FE
    AEON Enhancer
    x1000 Radeon Driver
    AEON linux for x1000

    All in range up to 200 GBP

    Also I had to buy
    Wi Fi card

    LAN card

    Southern Island gfx card

    All in range of 200 GBP

    This is indeed small claim but its important to have IT salers and suppliers from UK being responsible.

    Delay was never communicated by AEON and AmigaKit

    When after about 1.5 years customer complained on unusubality with beta software and wished to return whole machine, he was denied by some strange 1 year base guarantee for whole machine, which should be 2 years by EU laws of time.
