He had the opportunity to attempt this before the trial began in early 2007, but he didn't. Imagine MorphOS developed and published as "AmigaOS 5.x" concurrently to Hyperion's AmigaOS 4.x ;-) Not saying the MorphOS team would even have wanted to have their OS published as "AmigaOS" at that point in time.
