SOLVED Cherry Darling (Ace of Hearts) Paid but NO GAME

    I am sad to have to pass on this cautionary tale of an 'alleged' supporter of the Amiga systems, but I paid via PayPal for the full version of Ace of Hearts over a month ago, but I have never had the game link supplied to me by the person accepting the payment - Markus Kunkel.

    I have fortunately been able to get my money back via PayPal, after having had no contact from any of the few messages I have sent to Markus or Cherry Darling (probably the same), including other requests by PayPal to get some response from him/the company, so I was refunded in full, but this has taken quite some time, and is a bitter disappointment to me, as I was trying to support any new game development by Cherry Darling, but I am sadly not going to do so again in the future. :-(

    It is up to any individual as to their actions of attempting purchase of any of their products, but I mention my 'tale of woe' for all to be aware of the situation that seems to currently exist with Cherry Darling and its products.

    I'm Daniel, the coder of Cherry-Darling.
    Sorry to hear of your issues :-(

    I have just been made aware of this incident and immediately contacted Markus to check for the cause of this.
    It looks as if the respective mails were simply overlooked (most likely because activity on this account went down to zero about a year ago).

    To compensate you for your unpleasant experience we decided to send you the Ace Of Hearts full versions for free. We hope this action resolves the issue for you.
    If everything went right this time you should have received the coresponding mail by Markus already. Or maybe you're already playing ;-)

    I can personally vouch for Daniel as he is one of the most honest people I've met. I can't speak for his former partner though (they have gone seperate ways).

    So I hope you will reconcider as Daniel is working on some really exciting projects right now :-)

    It's just a pity that it came to me having to make the post/thread in the first place, but I thought others ought to be aware of the situation, as I would not have wanted the same to have occurred to them, though now I find there was no real cause for concern - thankfully.

    I'm not saying you are wrong for doing what you thought was necessary to warn other users, but I wish users of any Amiga, or Amiga inspired platforms would realize that our community no longer has a viable commercial market, and most, if not all software and hardware projects are being done by 1 or 2 individuals, not a company of many people, or a store, also with many employees, which can more quickly resolve problems with deliveries, quality control issues, bug fixes, etc. We as customers can expect sellers of any products to be honest and hope that they attempt to meet our expectations as quickly as possible, but my own expectations are very much more lenient toward Amiga & Amiga inspired programmers and hardware creators, knowing that most are working alone and have "real life" issues that can often delay their ability to deliver in a time frame we are used to receiving from commercial software companies for other platforms that sell products in the thousands, or tens of thousands, or hardware manufacturers which produce products in similar quantities. I mean it is not like going to Wallmart, or any other huge store chain and getting instantly what we are looking for. So, my suggestion to all users buying software and hardware products for our hobby computers is to be more patient, and make an extra effort to resolve the problem, before starting threads like this one. Perhaps start a thread titled "Need help contacting Cherry Darling to resolve problem", on this site, as well as a few other Amiga, and MorphOS forum sites, which will increase your chances that someone who knows how to contact the people you need to talk with to resolve the problem, will show you how to contact those people directly, or they will forward your desire to contact Cherry Darling to someone who can reply to your questions.

    Too often we see knee jerk reactions, like this one, after only a few days or weeks, when no reply is received from the company or person the buyer is trying to contact.

    Like I wrote at the beginning of this reply, I am not criticizing you for doing anything wrong, just suggesting that it might be better in the future to ask for help in contacting the person you need to discuss a problem with, before you go to a public forum site and complain about the problem you haven't yet been able to discuss with the only people who can resolve it.

    There are very few people in our community who could be considered to be "crooks", "thieves", or dishonest con men, and almost all disputes end up to be a failure to communicate, or a misunderstanding of some previous communication. There are rare exceptions, but this community is so small now, the dishonest people are quickly identified and run out of our community, never to return (except for perhaps some people or entities that the community is too dependent on, who lie and yet are permitted to stay within our community, because they cannot be replaced, and their departure would possibly harm the community, even more than the lies they have told). ;-)

    Edit: I hope everyone can figure out who I am referring to, when I write about a person or entity that lies, but users of a certain platform can't get rid of, and you all know that my reference to lies has nothing to do with Daytona. He is one of the best programmers we still have in our community, a treasure to applaud and reward with our support and purchases of his software.

    Wings Remastered and Tower 57 are two commercial games that are being ported to NG :-)

    And rest asured: I find it okay that you wrote this post here. After all you tried all official ways to resolve this and failed, so this was the only remaining option from your side.

    Yes, I guess I would have done the same, also to warn others. Although I probably would have been a bit less "hard", like what amigadave said. Something like "anybody knows what's up with those guys?".
    But well, I understand your move nevertheless. Once you reached some frustration-level it's not invalid to select the apropriate words IMHO and people simply react and act different, so I'd say your post was reasonable - and I for myself have no problem with it :-)

    The Cherry-Darling project is pretty much dead, I'm working by myself for now under my own label GoldenCode.eu.
    Current projects are what Yasu just said:
    - porting "Wings Remastered" to all NG Amiga flavours (almost done TM , two more weeks TM :-P )
    - porting "Tower 57" to all NG Amiga flavours (not started yet, waiting for the PC version to be completed)

    And this OpenGLES2 for AmigaOS4 / RadeonHD SI (finished (well, as far as possible with the current Warp3D Nova state)), but this is of course not relevant to MorphOS.

    I waited for a month - at which point I had to initiate a PayPal claim/dispute or lose the money I sent, and get nothing, so I chose the latter, after I had already sent a few emails to Cherry Darling, Markus Kunkel - with no reply. PayPal sent 2 messages as well, and they too got no reply, so on that basis I made the decision to post here for others to be aware of these circumstances, and be cautious if they sent any money.

    I don't propose to give you details of what I was told by Daniel in a PM, but suffice to say that I was most likely never going to get a reply from Cherry Darling nor were PayPal ever likely to get a response from Cherry Darling/Markus Kunkel. So I feel vindicated anyway.

    This is just so you know that as many avenues to contact the author had been attempted before this thread was initiated, but I am ever so grateful to Daniel for his excellent/speedy response and complimentary issue of the full game . . . how often do you get that type of fix?

    Like I wrote in my post, I wasn't saying that you did anything wrong, I was only telling you what I might have done, and suggesting an alternative course of action. You of course, are free to communicate any way you wish, and approach any recurrences of this problem with other people the exact same way that you did this time. All I meant with my post is that I would have first tried to get alternate methods to contact any of the Cherry Darling owners/employees/partners, by asking here and elsewhere, then if I was still unsuccessful, I would have shared a warning with others on a public forum site.

    I would have done the same as you with PayPal, as the clock was running out for you to act. Each person can react to situations differently, and there is never just one correct course of action for everyone.
